What is the Tulsa Mayfest 2017 Original Poster Art Painting Raffle?
This Raffle raises funds for Mayfest in its continuing efforts to support and promote a broader knowledge and appreciation for arts and humanities in the Tulsa and greater-Oklahoma region, and to provide free access to the public for this tribute to art, music, food and fun.
The winner of the Raffle will receive one-of-a-kind painting by Tulsa artist Matthew Bearden entitled, “The Bonds of Time” (the “Prize”). This painting, which is 36” x 36” framed acrylic on canvas, was the inspiration for Mayfest’s 2017 poster.
Who can buy a raffle ticket?
Any person 18 years of age or older who is eligible may enter and win the Raffle.
How much do the raffle tickets cost?
A single entry for the Raffle will be issued in conjunction with a $10.00 voluntary contribution made for the purpose of raising funds for Mayfest.
There is no limit to how many tickets an entrant may purchase.
How do I purchase a raffle ticket?
• Online – Visit http://tulsamayfest.org/
• In Person: during Mayfest or any locations designated by Mayfest as a location where tickets may be purchased.
Each ticket will be individually numbered. For in-person entries, a member of Mayfest will immediately remove a stub that has a corresponding number to the ticket that will be provided to the entrant. For online entries, a member of Mayfest will remove a stub that has a corresponding number on a physical ticket, and, shortly after the entry is processed, the entrant will receive an email at the email provided at the time of their contribution, which will correspond with the number on the stub and the physical ticket.
Each stub will be stored under the supervision of Mayfest members until the random drawing when the winner is selected.
When does the Raffle start and when does it end?
Entries will be accepted in person starting on Tuesday, March 28, 2017 and ending Sunday, May 21, 2017 at 3:00 p.m. All online entries will be accepted starting on March 29, 2017 and ending Saturday May 20, 2017 at 11:59 p.m. CST.
What are my odds of winning the Raffle?
The odds of winning the Prize depend on the number of eligible entries received.
How is the Winning Ticket Selected?
The winner of the Raffle will be selected in a random drawing under the supervision of a member of Mayfest at the Bartlett Square stage on Sunday May 21, 2017 at about 4:00 p.m.
Do I have to be present to win?
No. If you win and are not present, you will be notified by phone and/or email based on the contact information provided at the time of submission of your entry. The winning name will also be posted on this website shortly after the drawing.
Are Raffle tickets tax-deductible?
No. The IRS does not allow raffle tickets to be a tax-deductible contribution.

Is this Raffle Legal?
Yes. Mayfest is a designated non-profit organization pursuant to 25 U.S.C. § 501(c)(3) and is a qualified organization pursuant to Oklahoma’s lottery laws, 21 O.S. § 1051, et. seq., and is legally allowed to conduct this charitable raffle.

OFFICIAL RULES AND REGULATIONS
Tulsa International Mayfest, Inc. (“Mayfest”) an Oklahoma nonprofit corporation and tax-exempt organization under Section 501(c)(3) of the Internal Revenue Code, is conducting the 2017 Original Poster Art Raffle (the “Raffle”) to raise funds for its ongoing charitable activities and purposes. These Official Rules and Regulations (the “Official Rules”) of the Raffle, set forth below, govern the Raffle, award of the Prize (as defined herein), and participation in the Raffle.
These Rules bind every person (a “Ticket Holder”) who buys or holds a Raffle ticket. By purchasing or holding a ticket, or otherwise participating in this Raffle, each Ticket Holder agrees (a) to be bound by these Official Rules and (b) that Mayfest’s interpretation and application of these Rules is conclusive and final.
The drawing of the Prize will take place on Sunday, May 21, 2017 on or about 4:00 p.m. CST. The Raffle will begin at approximately on Tuesday, May 28, 2017 6:00 p.m. CST. Online purchase of tickets will begin on Wednesday, May 29, 2017. The final ticket purchase deadline for entry for in-person purchases is Sunday, May 21, 2017 at 3:00 p.m. CST and for online entries on Saturday, May 20, 2017 at 11:59 p.m. CST. There is no limit to the number of tickets that may be purchased/sold. The number of tickets sold determines the odds of winning.
Only one Eligible Ticket Purchaser (as defined below in the “Eligibility” section of these Rules) may purchase a ticket. This means, (a) one name per ticket and (b) one purchaser per ticket. An Eligible Ticket Purchaser may designate another person a Ticket Holder, however only the name listed on the ticket shall be eligible to win the Prize. In the event of a dispute between a Ticket Purchaser and a Ticket Holder arises, Mayfest will award the Prize to the person named on a ticket, and Mayfest will have no further duties or obligations with respect to the division of the Prize and all persons named on a ticket as Ticket Holders release Mayfest from all claims relating to the award of the Prize or its division among other persons on a ticket named as Ticket Holder. In the event a ticket lists more than one person, and that ticket is selected as the winner, Mayfest will disqualify that ticket and select a new ticket to determine the winner.
The IRS has taken the position that amounts paid for chances in Raffles, lotteries or similar drawings for valuable prizes are not gifts and therefore do not qualify as deductible charitable contributions.
To be eligible to purchase a ticket, a ticket purchaser (an “Eligible Ticket Purchaser”) must (a) be at least 18 years old at the time of purchase, (b) not be precluded by any local, state, and federal laws and regulations from holding or purchasing a ticket or participating in a raffle, and (c) be a person residing in a state, county or city where the Raffle is not prohibited.
If a ticket is purchased by an Eligible Ticket Purchaser who designates another person as the Ticket Holder, then that person must (a) be at least 18 years old at the time of purchase, (b) not be precluded by any local, state, and federal laws and regulations from holding or purchasing a ticket or participating in a raffle, and (c) be a person residing in a state, county or city where the Raffle is not prohibited.
Mayfest reserves the right to require reasonable evidence of the eligibility of an Eligible Ticket Purchaser or Ticket Holder at any time and to void any ticket sold to a person who does not meet the eligibility requirements or who is precluded by applicable law from holding a ticket or participating in a raffle.
Mayfest reserves the right, in its sole discretion to cancel, terminate, modify or suspend the Raffle should (in its sole discretion) a virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Raffle. In such case, Mayfest may select the winner from all eligible entries received prior to and/or after (if appropriate) the action taken by Mayfest. Mayfest reserves the right at its sole discretion to disqualify any entries it believes in good faith are generated by a so-called spam or automated e-mail program or via scripts and automated submission. Mayfest also reserves the right to disqualify any entries it believes in good faith are not complete or do not adhere to the rules or specifications, or through fraudulent or other methods attempts to circumvent the rules, tamper or attempt to tamper with the entry process or the operation of the Raffle or this website.
Any attempt by an entrant to deliberately damage any website or otherwise undermine or tamper with the legitimate and lawful operation of the Raffle may be a violation of criminal and civil laws and should such an attempt be made, Mayfest reserves the right to seek damages from any such person to the fullest extent permitted by law.
HOW TO ENTER
Eligible Ticket Purchasers may purchase Raffle tickets online at http://tulsamayfest.org/, or in-person during Mayfest festivities, or at any location specifically designated by Mayfest. Pursuant to Oklahoma law, Mayfest has not hired or contracted with any person or business entity to conduct the Raffle, sell Raffle tickets, or to solicit contributions in connection with the Raffle on behalf of the organization. To the extent any persons or business entities allow for the purchase of Raffle tickets on their premises, such is purely gratuitous and done voluntarily and in support of Mayfest’s charitable endeavors, and shall not be construed as that person or business entity having been hired or contracted for any valuable consideration in association with the sale of Raffle tickets on behalf of Mayfest.
At the time of purchase, Eligible Ticket Purchasers must provide their full name, address, phone number, email address credit card number credit card security code and expiration date, (if payment is not made by cash) and such other information as Mayfest may require. Eligible Ticket Purchasers may not purchase tickets by email or voice mail. All entries must include payment by cash, money order, or credit card.
Tickets will be distributed and ticket numbers will be assigned in the order that payment is received. All payments will be deposited upon receipt. Mayfest reserves the right to reject any entry form that it deems defective, illegible, ineligible, or submitted without “good funds.”
Unless specifically requested in writing, Mayfest will not mail Raffle tickets to Ticket Holders. Each ticket will be individually numbered. For entries purchased in person, a member of Mayfest will immediately remove a stub that has a corresponding number to the ticket that will be provided to the entrant. For online entries, a member of Mayfest will remove a stub that has a corresponding number on the physical ticket, and, shortly after the entry is processed, the entrant will receive an email from Mayfest with an unofficial raffle ticket as receipt for the ticket purchases. This receipt will provide a number which corresponds with the number on the stub and the physical ticket. Unless specifically requested in writing, the physical ticket associated with an online entry will be discarded at Mayfest’s discretion, and a copy of the email providing the ticket number shall constitute proof of the entry. Each stub will be stored under the supervision of Mayfest officials until the random drawing when the winner is selected.
All Raffle ticket sales are final. Mayfest will make no refunds except at the discretion of Mayfest. Mayfest assumes no responsibility for lost, late, misdirected, or non-delivered mail or fax messages, or any other failure to receive orders or deliver receipts prior to the drawing deadlines.

Actual/appraised value may differ at the time the Prize is awarded.
A random drawing will take place on Sunday, May 21, 2017 at approximately 4:00 p.m. CST on the Bartlett Square Stage during Mayfest festivities. The winner will be notified by telephone and/or email; Mayfest reserves the right to determine the method of notification. The winning name will also be posted on this website shortly after the drawing. The winner must claim their prize within three (3) business days after the date of notification of such prize. If the winner fails to respond to the prize notification within the specified three (3) business days, will be considered that the winner has forfeited the prize and an alternate winner may be selected from the pool of eligible entries. The number of eligible entries received determines the odds of winning. In the event of a dispute regarding the identity of the person submitting the entry, the entry will be deemed to be submitted by the person whose name appears on the ticket, and should the person not be able to prove his/her identity against the registered name the entrant will be rejected and result in the disqualification of the entrant from the giveaway. The drawing will be conducted under the supervision of Mayfest official(s). The decisions of Mayfest are final and binding in all matters relating to this Raffle.
The winner may be issued an IRS 1099 tax form for the approximate retail value of the awarded Prize. The Prize is provided “as is” with no warranty or guarantee by Mayfest, either express or implied. No transfer, substitution, upgrade, credit, refund or cash equivalent for prizes is allowed except at Mayfest’s sole discretion. Mayfest reserves the right, in Mayfest’s sole and absolute discretion, to substitute a prize of equal or greater value if the Prize cannot be awarded as described for any reason. Please allow 2-4 weeks for delivery of the Prize. Insurance, tips, taxes and other expenses not specified are not included and are the sole responsibility of the winner. If a prize or prize notification is returned as undeliverable, this will result in disqualification and an alternate winner will be selected. All federal, state or other tax liabilities (including income taxes) arising from this Raffle will be the sole responsibility of the winner. Except where prohibited by law, the winner’s entry and acceptance of the prize constitutes winner’s permission for Mayfest and those acting under Mayfest’s authority to use said winner’s name, photograph, likeness, statements, biographical information, voice, and address (city and state only) on a worldwide basis, and in all forms of media, in perpetuity, for advertising or promotional purposes without review or further compensation.
Nothing in these rules or any other information related to this Raffle shall be construed as tax advice nor is it intended to be relied upon by the Prize winner.
GENERAL CONDITIONS AND RELEASES
An entrant or winner may be disqualified from the Raffle if he or she fails to comply with each provision of these official rules, as determined in the sole discretion of Mayfest.
Mayfest shall not be liable for (1) failed, returned or misdirected notifications based on inaccurate information provided by the winner on the sweepstakes entry form; (2) entries, and responses to winner notifications which are lost, late, incomplete, illegible, unintelligible, postage-due, misdirected, damaged or otherwise not received by the intended recipient in whole or in part or for computer or technical error of any kind; (3) any electronic miscommunications or failures, technical hardware or software failures of any kind, lost or unavailable network connections, or failed incomplete, garbled or delayed computer transmissions which may limit an entrant’s ability to participate in the Raffle; or (4) any technical malfunctions of the telephone network, computer on-line system, computer equipment, software, program malfunctions or other failures, delayed computer transactions or network connections that are human, mechanical or technical in nature, or any combination thereof, including any injury or damage to entrant’s or any other person’s computer related to or resulting from downloading any part of this Raffle.
Unless prohibited by applicable law, entry constitutes permission to use an entrant’s name, photograph, likeness, voice, address (city and state) and testimonials in all media, in perpetuity, in any manner Mayfest deems appropriate for publicity purposes without any further compensation to such entrant. By entering or accepting a prize in the Raffle, the winner agrees to be bound by these Official Rules and to conform to all federal, state and local laws and regulations. When applicable, the winner will be required to execute and return to Mayfest within thirty (30) business days an Affidavit of Eligibility and Liability/Publicity Release to be eligible for the Prize or an alternate winner will be selected. The winner may be required to furnish proof of identity, address and birth date in order to receive the Prize.
By entering, an entrant agrees to release and hold harmless Mayfest and affiliated entities, directors, officers, employees, attorneys, agents, and representatives from any damage, injury, death, loss, claim, action, demand, or other liability (collectively Claims) that may arise from their acceptance, possession and/or use of the Prize or their participation in this promotion, or from any misuse or malfunction of the Prize awarded, regardless of whether such Claims, or knowledge of the facts constituting such Claims, exist at the time of entry or arise at any time thereafter. This Raffle shall be governed by Oklahoma law. By participating in this Raffle, entrants agree that Oklahoma courts shall have jurisdiction over any dispute or litigation arising from or relating to this Raffle and that venue shall be only in Tulsa, Oklahoma. Any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Raffle, shall be resolved individually, without resort to any form of class action, and solely and exclusively by mediation within (30) days of the dispute. If mediation fails, then by a non-jury trial in the Tulsa County District Court, State of Oklahoma. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys’ fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Raffle), and participant further waives all rights to have damages multiplied or increased.
If a court of competent jurisdiction finds that any provision of these Official Rules, or their application to a particular person or circumstance, is invalid or unenforceable to any extent, then the remainder of these rules and the application of these rules to other persons or circumstances, shall not be affected by that determination, and shall remain enforceable to the fullest extent permitted by law.
